By accessing and using the Pose Studios LLC website (the “Site”), you acknowledge that you have read, understand, and agree to these Terms and Conditions of Use. If you do not agree, please do not use the Site. These Terms govern your use of the Site and any services, information, content, or materials made available through the Site. Pose Studios LLC may update or modify these Terms at any time, without prior notice, by posting updated Terms on this page. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

Restrictions on Use of Materials: The content, features, and functionality on this Site, including text, graphics, logos, images, and other materials (collectively, the “Content”), are protected by copyright, trademark, and other applicable laws. Unless otherwise stated, the Content is provided for your personal, non-commercial use. You may download or print limited portions of Content for personal, non-commercial use only, provided you keep all copyright and proprietary notices intact. You may not copy, reproduce, republish, upload, post, transmit, distribute, store, modify, create derivative works of, or publicly display any Content for any commercial purpose without prior written permission from Pose Studios LLC or the applicable rights holder. Indemnity: You agree to indemnify, defend, and hold harmless Pose Studios LLC and its owners, officers, directors, employees, contractors, instructors, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or related to (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any rights of another person or entity. Pose Studios LLC reserves the right, at its own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, and you agree to cooperate with that defense. You may not settle any matter without Pose Studios LLC’s prior written consent.

POSE STUDIOS LLC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Acknowledgment Regarding Communications: You acknowledge that transmissions to and from the Site may not be confidential and may be intercepted by others. By submitting any communications through the Site, you acknowledge that no confidential, fiduciary, or otherwise special relationship is created between you and Pose Studios LLC beyond what is stated in these Terms.

Governing Law; Venue: These Terms are governed by the laws of the State of New Jersey, without regard to conflicts of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in New Jersey, and you consent to personal jurisdiction in those courts.

LIABILITY WAIVER: In exchange for permission to participate in classes, private sessions, workshops, events, or other activities offered by Pose Studios LLC, I hereby enter into this release and waiver of liability, assumption of risk, indemnification agreement, and consent to recording. I represent and warrant that I am in good physical health and do not suffer from any medical condition that would limit or prevent my participation in the classes offered by Pose Studios LLC, and I understand that it is my responsibility to consult with a licensed physician prior to and regarding my participation in any yoga, Pilates, fitness, or exercise classes. I acknowledge that participation in yoga, hot yoga, Pilates, and other fitness activities is inherently strenuous and involves risks, including but not limited to muscle strains, sprains, dehydration, dizziness, fainting, abnormal blood pressure, heart complications, injury, illness, or death. I further acknowledge that the studio is heated up to 110 degrees Fahrenheit (110°F) and may at times reach temperatures in excess of 110°F, that such activities may not be recommended for pregnant individuals or individuals with certain medical conditions without physician approval, and that I knowingly, voluntarily, and expressly assume all risks associated with my participation, whether known or unknown, foreseeable or unforeseeable. I agree to move mindfully, work within my personal limits, and follow all verbal and written instructions so that I may safely participate, and I understand that I should discontinue any activity that causes pain, dizziness, discomfort, or distress. In consideration of being permitted to participate, I, on behalf of myself, my heirs, spouse, executors, administrators, personal representatives, and assigns, hereby waive, release, discharge, indemnify, and hold harmless Pose Studios LLC and its owners, officers, directors, employees, independent contractors, instructors, agents, volunteers, landlords, representatives, and affiliates from any and all liability, claims, demands, causes of action, damages, losses, costs, or expenses, including attorneys’ fees, arising out of or related to my participation in any classes or activities, including claims resulting from personal injury, illness, death, or property loss, whether caused by ordinary negligence, passive negligence, or otherwise, to the fullest extent permitted by law. I hereby consent to receive emergency medical treatment deemed necessary by licensed medical personnel if I am injured or require medical attention during my participation and understand that I am solely responsible for all costs associated with such treatment, transportation, or evacuation. I acknowledge that Pose Studios LLC utilizes security cameras within the studio for safety, security, and operational purposes and consent to being recorded or filmed in common areas and studio spaces, waive any expectation of privacy in areas under video surveillance, and release the Studio from any liability arising from such recordings. I understand that this agreement is intended to be as broad and inclusive as permitted by law, that if any portion is held invalid the remaining provisions shall continue in full force and effect, that I have read and fully understand this agreement, that I understand I am giving up substantial legal rights including the right to sue, and that I am legally competent and voluntarily agree to its terms.
